Conditions of Participation in Polish Landscape Programs
A. Definitions
1. This Form is a standard document; the electronic version of it conforms to the requirements of eCard, the firm authorizing the transaction, for the purchase of Polish Landscape services that are available through the Web page, www.polish-landscape.pl.
2. "Client" means a person fully capable of understanding the Polish Civil Code who purchases a product/products developed by Polish Landscape.
3. "Travel Agency" or "Tour Operator" ("Operator") means a licensed organizer of tourist activities and in particular refers to Polish Landscape -Tours and Promotions, Ltd.
B. Purchase of Services
1. An electronic purchase through our Web page, www.polish-landscape.pl, is executed by filling out and returning the Form and payment electronically for the selected services. By returning the completed Form with payment, the client accepts the Conditions of Participation.
2. The Client bears complete responsibility for any effects resulting from the submission of inaccurate or incomplete data on the Form.
3. The Operator has the right to restrict access to the electronic service temporarily with no reason given, and bears no responsibility when the system is inaccessible for reasons beyond his control.
4. A reservation is effective after payment is submitted electronically by credit card, by written confirmation through fax or e-mail order, by bank transfer, or in cash, at the Polish Landscape office or through an authorized receiver under contract to Polish Landscape.
C. Form and Conditions of Payment
1. When payment is made by credit card, the Client must submit on the form all data necessary for the authorization of the transaction by eCard. The sum shown on the form will not be posted on the Clients credit card account at the time of the transaction, but should be posted no later than two business days prior to the tour or other service. Failure to pay the remainder by the date indicated will render the reservation invalid.
2. Polish Landscape reserves its bank transfer form exclusively for parties with whom it maintains a signed Contract of Cooperation, or has arranged for such a form through correspondence.
3. The cost of services not specified in the order or included in the requested program, such as additional overnight stays, meals, and TV or minibar charges, must be borne by the Client.
D. Confirmation
1. Our agency's electronic system can confirm reservations automatically when information supplied by the client about requested services is certified by the Operator.
2. Confirmation will be sent within 2 business days to the e-mail address given on the Form.
3. The confirmation will confirm the information in the reservation, or, if the reservation is refused, will inform the client of the unavailability of services on the date in question. The purchase of services goes into effect when the client receives the confirmation.
E. Responsibilities and Rights of the Operator
1. The Operator agrees to make every effort to provide the agreed-on services for the period stipulated in the Form.
2. In the event that the agreed-on services cannot be provided due to the neglect or default of parties other than the Operator, the Operator may offer comparable services at another time than that indicated by the Client in the Form.
3. In the event, however, that the Client does not agree to accept comparable services, or the services appear impossible to provide, or would entail excessive cost, the Operator must return the Client's payment within 3 weeks, with the exceptions noted in Part F (below).
4. The return of payment to the Client will terminate completely the Client's claim on the Operator for services not provided.
5. The Operator will not be responsible for transient inconveniences that may arise in contracted facilities such as hotels: for example, temporary lack of water, failure of heating or air conditioning systems or other equipment, lack of electricity; for inconveniences caused by acts, events or circumstances beyond the control of Polish Landscape, including strikes; or for other unforeseeable inconveniences.
6. In the event of extraordinary circumstances including but not limited to natural disasters, epidemics, quarantine, strikes, government action or inaction, outbreaks of war or other hostilities, terrorist attacks or other exceptional situations that render the proper delivery of services under the terms of the purchase impossible, the Operator will be relieved of its obligation.
7. The Operator reserves the right to cancel a tour, to refuse to accept or retain any person as a member of a tour at any time, or to make changes in the published itinerary whenever, in its sole judgment, conditions warrant, or if it deems it necessary for the comfort, convenience or safety of the clients.
F. Conditions of Cancellation
I. In the event that an individual local tour reservation or individual hotel reservation is canceled the following fees will be assessed:
1. A handling fee in the amount of 50 Polish zlotys if a notice of cancellation is received at least 48 hours before the beginning of the tour or other activity.
2. Payment for the first day of the hotel stay, if the reservation includes an overnight stay. The full cost of other services agreed on in the reservation will be charged if written cancellation is received 48 hours or less before the beginning of the tour or other activity.
3. The full cost of the reservation will be charged if the Client cancels, does not appear or does not use the services on the agreed-on date and does not submit notice of cancellation in writing before that date.
II. In the event of the Group Hotel Reservations
1. In the event that a group hotel reservation must be cancelled, notice of cancellation should be submitted five weeks or more in advance for a full refund.
2. If a group hotel reservation is cancelled fewer than five weeks but more than two weeks before the agreed-on date of stay, the Client will be charged the cost of the first night's stay in the hotel.
3. If a group hotel reservation is cancelled 15 days or fewer before the agreed-on date of stay, the Client will be charged the full cost of the group's accommodation in the hotel during the period covered by the reservation.
III. In case of the cancellation of the outgoing tour the following fees will be assessed:
1. A handling fee in the amount of 200 Pln if the Client withdraws from the already signed Agreement. The handling fee ? 200 Pln is included into the price of excursion.
2. 20% of the cost of the trip if the cancellation in written occurs 20 days before the departure.
3. 50% of the cost of the trip if the cancellation in written occurs 13 days before the departure.
4. 75% of the cost of the trip if the cancellation in written occurs between the 12 and 4th day before the departure.
5. 95 percent of the cost of tour if the cancellation occurs 3 days or fewer before the planned beginning of the trip or if the Client does not appear at the place scheduled.
6. Clients who terminate their stay on their own responsibility will not be eligible for refunds for the unused portion of the trip. Clients may purchase insurance for the costs of cancellation in our office.
IV. If the reservation is canceled in a timely manner, the appropriate refund will be made by bank transfer to the account indicated by the Client in his/her notice of cancellation.
G. Personal Data
1. By filing the reservation electronically, the client agrees to allow his personal data to be stored in the Operator's database.
2.The Client's data will be retrieved exclusively for the purpose of providing services, facilitating the filing and confirmation of future reservations, and for marketing purposes, in accord with the provisions of the Polish law entitled "On the protection of personal data" and enacted August 29, 1997.
H. Acceptance of the Conditions of Internet Sales
1. When the Client reserves services and pays by Internet, he/she knowingly agrees to the Conditions of Participation set forth in this document.
2. Any matters not dealt with in the above Conditions are regulated by the pertinent provisions of the Polish Civil Code.
